Rushford Village approves Jenkins' shop/office permit; request for living quarters deferred pending legal review

The Rushford Village Planning and Zoning Commission approved corrected applications from Dominic Jenkins on April 21 for a new shop/office (not designated as living quarters) and a lean onto a semi trailer on State Highway 16. The commission permitted an office/shop to include a fully functioning breakroom.
Jenkins told the commission he would like to have living quarters in the shop/office for two years and to provide a place for employees to shower and occasionally sleep. Commissioners said it was not known whether living quarters would be allowed in a commercial district and noted a similar arrangement had not been allowed in the case of Featherstone Farms. Planning and Zoning Administrator Jon Pettit said he will consult with City Attorney O’Koren to determine whether the requested temporary living quarters are permissible.
The minutes record the shop/office and the lean-on applications as approved; they do not record a formal motion or vote tally associated with those approvals. Any change that would permit living quarters in a commercial district would require a legal determination or a formal change in local code or administrative interpretation.
