Planning/Zoning Administrator Jon Pettit reported multiple new permits at the May 5 meeting and raised a substantive issue about a permit application for a proposed 3,600 square‑foot house at 41705 State Highway 30. Pettit said Beacon mapping indicates the property is within a bluff‑protection area and that the parcel has no buildable area under that mapping. He said the issue had been made clear to the realtor in prior discussions.
City Attorney Joseph O’Koren advised that, if the application does not meet code, the permit should be denied unless the property owner seeks and obtains a variance. O’Koren also said that city code cannot override state or federal protections related to wetlands or bluff protections; he said he will check options regarding renovation of the existing non‑conforming house on the property.
Pettit said he will contact the landowners to discuss the status and next steps. Separately, the council reviewed proposed revisions to the zoning fee schedule but voted to table that discussion to allow members more time to review the proposed changes (motion by Robert Hart, second by Mike Ebner, carried).
