Eric Ruden of the Housatonic Valley Association and Robin Casio of GZA described a culvert‑replacement project on Rattlesnake Mountain Road over Marshbrook, saying the existing 24‑inch corrugated pipe is deteriorated and undersized and that the preferred replacement is an embedded, elliptical aluminum structural plate culvert roughly 9.9 feet wide with two feet of naturalized sediment at the bottom to permit aquatic organism passage.
Ruden said the project emerged from a 2023 municipal stream‑crossing management plan and successful grants from the Massachusetts Division of Ecological Restoration. Casio described resource‑area findings from fieldwork: Marshbrook is perennial at the site, bordering vegetated wetlands (BVW) and riverfront area exist upstream and downstream, and the design responds to upstream impoundment that makes the bankful width larger than downstream.
The presenters said accommodating the larger culvert and required guardrails will require widening the paved roadway from about 16 feet to 18 feet for roughly 100–110 feet of road. They reported approximately 651 square feet of permanent BVW impacts from grading and bank stabilization work and proposed greater than 1:1 compensatory BVW replacement (677 square feet in two areas: upstream and downstream). Casio added that the selected culvert reaches are sized to limit excavation and ledge removal compared with an alternative wider (greater than 10 ft) option.
Commissioners pressed for details on mitigation and invasive‑species management. A landowner and several commissioners raised concerns about phragmites (fragmites) spread; presenters said any excavated soils from phragmites areas would be excavated to about six feet and removed from the site and that the Nature Conservancy had agreed to opportunistic downstream treatment as funding and capacity allow. When asked about mitigation success rates, the presenters acknowledged variable outcomes by site and agreed that the commission should consider monetary compensation options in lieu of replication where appropriate.
No regulatory decision was made at the presentation. Presenters offered to schedule a site visit and the commission indicated it would continue review at a future meeting after members and staff have had a chance to review permit‑file details and consult with state reviewers. "We flagged bank, high and BVW resource areas in the field," Casio said; "we're proposing mitigation areas both upstream and downstream and we expect the mitigation will be successful because groundwater supports those areas."
