The Manchester City Council voted to decline a retail license application for a device/tobacco outlet after staff said the proposed business likely would not meet statutory site and display requirements under newly enacted state rules.
Tim introduced the item and asked staff for comment. Ben, who inspected the property and reviewed guidelines, told the council he did not believe the proposed layout would keep prohibited items out of view of people under 21 and said other Iowa cities had denied similar permits.
“...I don’t see how they’re going to really meet the guidelines,” Ben said, adding the city has the authority to deny such permits and that other cities have already declined similar applications.
Councilor Bill moved to decline the application, Linda seconded and the motion carried with recorded affirmative votes (Bill, Linda, Brian and the presiding voter). The denial means the applicant cannot sell the device‑category products described in the application under current local approval.
