During opening business the Wakefield Board of Health paused its planned reorganization after a member raised concerns that adding the reorganization to the agenda at this meeting could expose the board to an open‑meeting‑law complaint or violate town‑charter posting requirements.
A member said the charter language appears to require reorganization 'immediately following the town election' or, if delayed, that notice be posted 14 days in advance. Staff responded that the agenda amendment had been added within the 48‑hour window permitted under 940 CMR 29.03, section 1(d), and that the board was not in violation of the open‑meeting law. Members disagreed on the interpretation and asked for written clarification from town counsel or the town administrator.
The board moved to take the item out of order, then voted to table the reorganization until the next scheduled meeting pending legal clarification. The board agreed it would reconvene promptly if legal advice indicated reorganization must occur sooner.
