City attorney says liens prevent Pleasantville from taking title to Adkins Carriers property

Pleasantville’s city attorney told the council May 19 that a title opinion he completed on property tied to Adkins Carriers, LLC shows multiple liens that stop the city from accepting title.
Attorney Bob Stuyvesant said he received the property abstract and completed a title opinion that revealed four significant liens on the parcel — a mortgage from 2020 and three later liens from 2025 — that together total more than $250,000. Because of those encumbrances, Stuyvesant said the city cannot take title unless the liens are cleared. The city had been considering a mutual release prepared by Adkins’ attorney; Stuyvesant said the County’s attorney reviewed that release and requested changes that are being returned to Adkins’ counsel for further discussion.
Councilmember Kyle Patterson asked when the trial is scheduled; Stuyvesant said the trial date has passed but a judge has scheduled a conference for some time in June. Councilmember Aaron Hurt asked about anticipated outcomes; Stuyvesant said next steps depend on his discussion with Adkins’ attorney and that if the city cannot obtain title free of liens it may pivot back to pursuing a $600,000 judgment. Stuyvesant said he will forward the title opinion to the other counsel and may request a special council meeting if immediate action is required.
There was no formal vote on litigation strategy at the meeting. The attorney’s update is a status report and staff will return with recommended next steps if needed.
