Yarmouth commission ratifies enforcement order after vehicle tracks disturb Englewood Beach

The Yarmouth Conservation Commission ratified an Enforcement Order on Feb. 19, 2026 addressing unpermitted regrading and vegetation disturbance at 1 Shore Road (Englewood Beach Condominium Association).
CA told the commission that vehicle tracks and vegetation disturbance were first observed in late January, and that a previous violation on the property occurred in 2019. Jessica DeMars, representing the condo association remotely, said the board is new and "they are willing to take the appropriate steps" to remedy the situation. CA recommended that the enforcement order be revised to require restoration to the former grade by hand-raking and to plant beach grass if needed after a spring follow-up inspection; the commission voted 6–0 to ratify the order with those revisions.
Why it matters: The order requires physical restoration work in a coastal beach and LSCSF (land subject to coastal storm flow) area intended to reestablish vegetation and dune form which help protect shoreline stability and habitat.
Next steps: CA will perform a spring follow-up inspection; restoration and planting will be required if needed.
