The Dennis Planning Board voted May 4 to support a Chapter 91 filing to construct and maintain beach stairs in the public right of way between 96 and 104 Shore Drive.
Paul Maher, who identified himself as the property owner and longtime resident, told the board he and other easement holders have prevailed in prior litigation and have a Department of Environmental Protection order of conditions allowing the stairs. “We won every single legal battle,” Maher said, summarizing the history and asking the board to sign the Chapter 91 paperwork so the project can be completed.
The board’s motion to support the Chapter 91 submission specified that Paul would sign the 91C documentation; the motion was seconded and carried on a roll‑call vote recorded as Jeff Aldridge, Liz Patterson, Michael McGhee, Sally Bickford and John Ontario Junior in favor.
Maher noted the contractor needs to attach an aluminum plate at the bottom of the stairs to complete the work. Board members expressed general support, and staff said they will transmit the signed materials to the state as part of the permitting process.
