Otis ZBA approves Albertsons’ reconstruction permit despite reduced side setback on one side

The Town of Otis Zoning Board of Appeals voted unanimously on Aug. 4 to approve a Special Permit allowing reconstruction of a nonconforming single-family residence for applicants Robert and Susan Albertson at 57 North Gate Island.
Robert Levesque of R. Levesque Associates presented plans indicating the proposal would largely reuse the existing footprint (approximately 26 feet by 40 feet). He said the finished floor area is proposed at 1,432 square feet and the proposed overall height is about 20 feet, 5 inches compared with the current 12 feet, 5 inches. The applicants have received an Order of Conditions from the Conservation Commission and will complete a detailed septic design after the meeting.
Board members identified inconsistent setback figures between site materials (EX-1 versus S-1). Member Wayne Woczyna noted the application listed a current setback of 5'4" and a proposed 6'5", while the site plan S-1 showed a smaller distance. Mr. Levesque acknowledged a plan dated 5/19/25 showing 3'9" and the applicant clarified they intended to keep the existing footprint while shifting the building slightly, which results in a 3'9" setback on one side and increased distance on the opposite side. Contractor Walter Tomala explained the intent to preserve an existing 26'x20' foundation under the house where possible.
Neighbor Scott Kerr of 130 Kibbe Road said he supports the project, calling the owners “long time neighbors” and saying he is "100% in favor." After discussion, on a motion by Terry Gould, seconded by RoseAnn DeRupo, the board voted 5–0–0 to approve the application using the hand-out S-1 that specifies the side-yard dimensions including the 3'9" measurement.
Chair Ward read the standard filing guidance reminding the applicants of the 20-day abeyance period and Registry of Deeds filing requirement before the Building Inspector issues a permit.
