Council discussed whether to allow homeowners to remove trees in the public right of way and directed staff to draft ordinance amendments to permit removal with controls. The proposal would allow a homeowner to seek approval from the city’s public works director or an arborist, sign a liability waiver, and, if using a contractor, ensure the contractor is licensed and insured.
The mayor explained the rationale: some constituents have complained about dead trees remaining in the right of way for extended periods and asked whether homeowners could remove them themselves. Staff recommended the city require prior approval and proof of licensing and insurance if a contractor performs the work, and to require a signed waiver shifting liability to the homeowner. ‘‘If you would like to move forward with removing your own tree, feel free to do so. It's on you. The cost is on you. The liability is on you, but we will go we will sign off on it,’’ the mayor said.
Council concurred that the city generally removes trees by safety and severity order and that no communities contacted reported compensating homeowners for removing their own dead trees. Council asked staff to draft proposed ordinance language and return it for council consideration.
Staff will prepare the draft amendments clarifying approval process, required documentation and contractor insurance requirements.
