Planning commission hears updates on short‑term rentals, Burntside waterline and ROW hearing

At the March 19 meeting the Planning and Zoning Administrator, Kochendorfer, reported 25 short‑term rentals in residential zones and two on a waiting list. The Projects Committee reported the Burntside waterline project will proceed; commissioners were told Ely Utilities Commission (EUC) adjusted utility rates to make the project eligible for certain grants.
Councilor Roose said a hearing will be scheduled for the right‑of‑way (ROW) vacation the commission approved in February, and staff noted a first meeting has occurred for a mass rezone ordinance with minor technical changes made to the ROW plat and parcel exclusions.
Commissioner Anderson raised a question about city liability related to approving conditional use permits and variances, citing concerns such as potential dog attacks on city property; staff said liability exists but responsibilities largely rest with land users and that the city carries general insurance. Kochendorfer said he will add a reminder about these matters to his "tips and tricks" guidance for future hearings.
Earlier in the meeting, Commissioner Hernesmaa moved to approve the Feb. 19, 2025 minutes; Commissioner Anderson seconded and the motion carried. The commission adjourned at 6:30 p.m.
