Stallings tables proposed ban on RV occupancy, asks staff to add hardship exceptions

Staff presented a text amendment (TX 26-05-02) intended to prohibit the occupancy of recreational vehicles on all properties within Stallings while allowing storage, arguing the change would simplify enforcement and protect neighborhood character.
Planner Matt summarized the proposed change: the ordinance would make RVs licensed motor vehicles but would prohibit occupancy while parked or stored on private property; violations would be handled with a notice/citation that permits 30 days to correct. Staff said enforcement under the current rule (90 days twice per year) is difficult when RVs are periodically occupied and vacated. "This gives a definitive no-occupancy line while allowing 30 days for a citation to be corrected," Matt said.
Council members raised questions about legitimate hardship cases such as a home destroyed by fire or long-term construction and whether a formal hardship or extenuating-circumstances permit process should be added to the ordinance. Town attorney and staff described current practice as lenient during hardships but advised council that a clear written hardship provision would be prudent.
Council voted to table the amendment, asked staff to add explicit language handling extenuating circumstances or hardship determinations (and to include an official permit or administrative review process), and continued the public hearing to the July 13, 2026 meeting.
Council members and staff said the goal is to provide a clear, enforceable standard while avoiding unintended consequences for residents with legitimate temporary needs.
