Council tables Curio change order for 2700 West lift station, city attorney warns of liquidated damages

Amy reminded the council that liquidated damages remained a potential penalty if the contractor failed to reach substantial completion by June 5 or final completion by June 19.
A council member moved to table the change order, another member seconded, and the motion passed on a roll call with all voting in the affirmative.
The tabling leaves the change order unresolved; the council instructed staff to ensure Curio follows the weekly inspection and reporting steps and to return the item for future consideration. Council members also asked that Curio appear at the July 20 meeting to report on progress.
The action leaves the schedule and potential liquidated-damages exposure in place pending further documentation from the contractor and updates from Gardner Engineering.
