Town attorney to train hearing officers as PZC readies enforcement cases

Town Attorney Dennis O'Brien told the Chaplin Planning & Zoning Commission on March 10 that the zoning enforcement ordinance (adopted Dec. 5, 2012) sets out the Notice of Violation, citation, fine assessment and appeals process and that two hearing officers—Rusty Lanzit and David Shenker—have already been appointed and sworn.
O'Brien said he will assemble the two hearing officers and train them together in the coming weeks. Chairman Doug Dubitsky asked the Zoning Enforcement Officer, Jay Gigliotti, to provide additional notice to two property owners with upcoming remediation deadlines; O'Brien said the ordinance’s main purpose is compliance and supported additional notice. Gigliotti and O'Brien agreed to meet in the upcoming week to review the outstanding enforcement cases and the process for assessment and collection of fines.
The commission discussed administrative steps including the scheduling of appeals hearings, assessment and collection of fines and coordination between the ZEO and Town Attorney. O'Brien’s remarks framed training and enforcement as a compliance-driven approach, and he confirmed both hearing officers are available to serve.
