England Homestead LLC withdraws permit for proposed substance-abuse facility; zoning staff says public was notified

At a Dec. 10, 2015 special meeting, the Chaplin Planning and Zoning Commission recorded that the applicant for zoning permit ZP15-044 (England Homestead, LLC) withdrew its request to operate a substance-abuse facility at 96 and 108 England Road.
Zoning Enforcement Officer Jay Gigliotti explained the sequence of events that led to the withdrawal and described the steps PZC staff took to notify the public that the application and its scheduled public hearing had been canceled. Gigliotti told the commission that the Connecticut General Statutes do not require publication of a legal notice when an applicant withdraws a zoning permit application and that staff had used multiple methods to get the word out on short notice. He also said the public hearing fee required for an application that would have had a public hearing had already been collected for this matter.
Commissioners asked about newspaper notice; Gigliotti reiterated the statutory limitation and the practical timing constraints that can make same‑day or last‑minute ads infeasible. No further action on ZP15-044 was recorded at the meeting.
The commission did not vote on the application itself because the applicant withdrew it; no hearing was held or rescheduled at this meeting.
