Maynard introduced agenda item two on Nov. 12 and, on advice of counsel, read the public language stating the commission "anticipates that it will meet in executive session in accordance with general law ... to discuss its strategy with respect to enforcement or litigation concerning prediction markets." A staff member serving as counsel recommended taking the public vote to enter executive session for each item and then holding the closed sessions together without returning to public session. Commissioner O'Brien moved the motion; Commissioner Broer seconded it, and the vote was 5-0.
