Commission reviews draft data center ordinance; commissioners press for enforcement, reporting and clarity on crypto-mining

The Saginaw Planning Commission held an extended discussion of a proposed data center zoning ordinance, focusing on definitions, inclusion of cryptocurrency mining, collocation of operators, annual compliance reporting and how to enforce those requirements.
Staff said the draft ordinance has new language to ensure cryptocurrency mining is included as a separate use when applicable and to cover collocated facilities. "Crypto mining is considered a separate sort of use from data centers," the staff presenter said, and staff "included language within the ordinance to make certain that there was no argument that cryptocurrency data centers are included within the ordinance as well." Staff also said the definition of data centers was broadened to account for multiple tenants or co-operators under one roof.
Commissioners pressed staff on annual compliance reports and enforcement. One commissioner asked whether required annual reports would be submitted by individual co-operators or the overall operator; commissioners and staff recommended making the overall operator responsible for consolidated reporting to avoid duplication. Commissioners also discussed possible enforcement tie-ins such as business licensing if operators fail to submit required reports.
Multiple commissioners raised concerns that state or federal legislation could preempt local zoning depending on statutory language. As one participant explained, "If they specifically adopted legislation that, for example, preempted local zoning..." then local ordinances could be superseded. Staff noted bills have been introduced in Lansing on data centers with a range of proposals — from statewide moratoriums to incentives — but no settled state approach yet.
Commissioners asked how the city is involved in advocacy and staff said Saginaw participates in the Michigan Municipal League, which monitors and advocates on municipal interests including zoning preemption. Staff said the draft ordinance is expected to go to a public hearing in July with a 15-day notice and invited commissioners to submit additional comments to staff (Christina) prior to publication of the hearing packet.
The meeting recorded discussion and direction (clarify reporting responsibility, consider enforcement mechanisms, and broaden citizen-participation expectations) but did not record a formal motion or vote on the ordinance itself; the item was left for revision and a public hearing.
