Council returned to old business on the property at 313 Western Avenue, which was declared a nuisance in May 2024. Members and staff reported difficulty locating and contacting the owner; one speaker said the property appears to be controlled by a complex corporate ownership structure that hinders outreach.
Council directed legal staff to begin court action to secure a judgment and to pursue filing liens and citations to recover mowing and maintenance costs. Members asked staff to prepare the necessary paperwork to certify costs to the county auditor as allowed, and to coordinate with Batesville City Court or other county authorities where appropriate.
Council also asked that staff prepare citations for another problem property on Western Avenue and to document hours and invoices for accumulated town labor and expenses to support any future lien or assessment.
