Applicant proposes withdrawal in 2½ Leonard Street subdivision dispute; board closes hearing

On Nov. 19, 2024, the Mount Kisco Zoning Board accepted a proposal to withdraw with prejudice an application related to a subdivision dispute at 2½ Leonard Street and closed the public hearing; the board then adjourned. No vote on the underlying dispute was recorded.
At its Nov. 19 meeting the Mount Kisco Zoning Board of Appeals recorded that the applicant for a matter involving 2½ Leonard Street proposed to withdraw the application with prejudice and explained a stipulation of settlement between 1 Leonard Street and 2½ Leonard Street.
Attorney Charles Martabano appeared on behalf of the property owner and discussed the settlement stipulation. The applicant did not appear in person. The board closed the public hearing on the matter by motion of Jacqueline Broth, seconded by Alex Roithmayr; Chairman Wayne Spector called the vote and the motion carried 5–0.
The minutes state the application was proposed to be withdrawn with prejudice; the board’s action at the meeting was to close the public hearing. The board then adjourned the meeting at 7:20 p.m. There was no recorded formal vote on approval or denial of the underlying interpretation of the Building Inspector’s determination in the minutes beyond closing the hearing and recording the proposed withdrawal.
