Carroll City Council voted to advance the 12th Street reconstruction through the special‑assessment process and to hire the Allers Law Firm to administer that procedure.
Randy summarized the engagement letter and said Allers proposed a flat fee of $13,615 plus an estimated $500 in expenses to manage the legal steps needed to establish special assessments under Iowa code. Council discussed prior experience on Adam Street, where roughly 10% of eligible homeowners elected special assessments and most paid off the assessment before certification.
Staff said seven property owners had signed petition/waivers to join the 12th Street special assessment and that 51 properties are listed on the preliminary plat; the preliminary assessment schedule identifies estimated assessed replacement costs for participating properties. Randy said owners are given 30 days after acceptance of the project to pay assessments in full; otherwise the assessment is certified to the county tax roll.
Council accepted the engagement agreement, approved the petition/waivers and adopted the resolution of necessity and the preliminary assessment schedule on roll‑call votes. Staff said final bid results and the DOT letting schedule (for the federal‑aid portion) will set exact costs; the DOT receives bids Feb. 19 and the council’s next meeting to finalize related hearings is Feb. 23.
