Commission issues negative determination for sewage system upgrade at 57 Hines Point; tribal notification suggested

The Tisbury Conservation Commission issued a negative determination June 2 for a required sewage disposal upgrade at 57 Hines Point, where two cesspools sit as close as about 5 feet from the top of a coastal bank.
Engineer George Sourati said the upgrade is being triggered by a property sale and would replace the existing cesspools with a septic tank and pump chamber located south of the house, pumping to a settling tank, then to a NitROE treatment unit and then to disposal. Mr. Sourati said a separate tank is included now to serve a potential future one-bedroom accessory dwelling unit (ADU); he explained that installing the ADU tank at construction provides additional treatment capacity even if the ADU is never built. A silt fence will be used for erosion control and no work will occur beyond the silt fence line; existing cesspools will be pumped out and backfilled in place. Board of Health approval is pending.
Commissioners asked staff to notify Wampanoag tribal representative Randy Jardin before excavation because Hines Point is recognized as an area of archaeological and cultural sensitivity, including known burial sites. John Best moved to issue the negative determination, David Reed seconded, and the vote was unanimous.
The commission recorded that Board of Health review remains outstanding and that the applicants must comply with any tribal consultation guidance and erosion-control conditions identified by staff.
