The Town of Yarmouth Board of Health discussed a proposed "Nicotine Free Generation" regulation on March 16 and agreed to continue review after collecting public input and obtaining legal guidance.
Board members described the proposal as a public-health measure aimed at reducing nicotine normalization. Mary Craig reiterated that the purpose of the proposed regulation is to "address public health concerns," and Board member Laurance Venezia and others noted health risks associated with chronic nicotine use.
Attorney David Lawler and business representatives including Richard Naoum of Cape Cod Farms spoke in opposition. Lawler argued that "nicotine products remain available online and in neighboring towns," suggesting that local restrictions may have limited effect on access. Bob Collett, a public speaker, said the goal is to gradually de-normalize nicotine use and compared the approach to the indoor smoking ban, which he said did not harm local businesses.
Public testimony came from both in-person and Zoom participants, including a representative from Station Avenue Convenience Store and Maureen Buzby, who provided comments via Zoom about NFG regulations in other towns. Opinions at the meeting were mixed, with supporters emphasizing long-term public-health gains and opponents pointing to cross-jurisdictional availability and cost/burden concerns for businesses.
The Board took no formal regulatory action at the meeting. Members agreed to forward comments and the draft proposal to Town Counsel for review; the matter will return to the Board for further discussion after legal review.
