He said the recent resurvey and subdivision removed the parcel's historical connection to the recreational center and outdoor rink, and that Public (P1) zoning is more restrictive than the neighboring Commercial (C1) district. Kochendorfer read findings of fact included in the agenda packet and recommended approval, citing Section 11.40 (Permissible Uses) and the city's Comprehensive Plan goals to encourage redevelopment and business growth.
Kochendorfer explained key regulatory differences: under P1 zoning the parcel faces 25-foot setbacks on front, side, corner and rear and a maximum total building coverage of 35 percent; C1 zoning, he said, would remove most setback requirements for this noncorner lot and permit up to 90 percent building coverage, allowing more flexibility for future commercial development.
Only one member of the public, Andy Hill of 2111 Sibley Drive, spoke during the hearing; Hill said he "supports development in Ely." No letters or phone comments were entered into the record, and no speakers voiced opposition.
Commissioner Hernesmaa moved to recommend approval of the rezoning; Commissioner Palcher seconded. The motion was recorded as carrying with four votes in favor, zero opposed and one abstention; Commissioner Heil recorded an abstention, saying he had missed the beginning of the meeting.
