During the meeting council reviewed three administrative items: a proposed mutual separation and reassignment of construction observation services for two ongoing projects, requested clarifications from Marion County on extra-territorial jurisdiction (ETJ) boundaries and minimum lot sizes, and approved a construction contract for the community center alley reconstruction.
Staff explained a mutual separation agreement that would transfer construction-observation services for the indoor recreation sanitary-sewer project and the library HVAC project from Beanstrick/Kim to Greenwood Consulting; staff noted the agreement does not absolve the original designer of liability for design issues and that both parties have agreed to the change. Council offered minor edits to language about "local" preferences but did not object to the transfer.
Staff also presented Marion County's two requests regarding the city's ETJ: a clarification that parcels 50.5% or more inside the city's jurisdiction will be taken by the city (whereas parcels with less than 50.5% may be deferred) and a request that parcels zoned A-1 in the county ETJ have a minimum three-acre lot size; staff reported the city is agreeable and noted the county will follow city zoning regulations in those cases.
The council approved Resolution No. 6998 to award the construction contract and performance bond for the community center alley reconstruction. Staff identified Teleconcrete Contractors as the contractor and listed an award amount in the packet (amount in packet: "276,9025" as shown). Council directed staff to ensure performance bonds and contract documents are in order and to coordinate sidewalks and other pedestrian improvements when work proceeds.
