Hebron planning board approves variance for 104 Sands Drive to allow 1,500-sq.-ft. accessory building

The Village of Hebron Planning & Zoning Board voted Oct. 7 to grant Juli and Thomas Price a variance allowing a 30-by-50-foot accessory building (1,500 square feet) and 12-foot side walls at 104 Sands Drive, exceeding the 1,400 square-foot and 10-foot side-wall limits in Zoning Code Chapters 1115 and 1159.
At a public hearing held before the regular meeting, applicant Juli Price said the structure is intended to comply with zoning needs and to reduce outdoor vehicle storage. "The building is to maintain the zoning ordinances," Price said, noting steps taken to address past violations. Board member Randy Wolf, citing the proposed dimensions, said "the square footage would be 1,500 square feet for the 30’x50’ building," and raised driveway-encroachment concerns; Community Development Assistant Caitlin Bowman said extending the driveway into the rear yard raised no issues on application review.
Vice Chair Mike McFarland told the board the property had received multiple violation letters since February 2024 for vehicles stored outdoors; Juli Price responded that they sold some motor vehicles and said the building would help mitigate future violations. Village zoning attorney Pete Griggs recorded on the public record an applicant amendment to increase the allowable accessory-building size from 1,400 to 1,500 square feet and to permit 12-foot side walls, and indicated the amendment could be considered at the meeting.
During the regular session, McFarland moved to approve the variance as amended; Randy Wolf seconded the motion, which Chair Rick Stoner stated and the board approved by unanimous vote of the three members present (McFarland, Wolf and Stoner). Board member Scott Jacobs and Mayor Valerie Mockus were absent.
The board did not record any public comments beyond the applicants’ testimony. Economic & Community Development Director Brittany Misner was absent and her monthly report was tabled; zoning attorney Pete Griggs presented his monthly report. The board scheduled its next regular meeting for Nov. 4, 2024, at 6:00 p.m., and adjourned at 6:41 p.m.
