The Dover Conservation Commission approved a Certificate of Compliance for Lot 5 Pegan Lane (DEP#144-0921) at its Jan. 21 meeting, concluding the applicant’s matter but requiring the recording of standard deed-conditioning language.
Conservation Agent Janet Bowser told the commission that the work required under the Order of Conditions had not taken place but that the conditioning language that obligates future owners was included in the OOC and must be recorded at the Registry of Deeds. Bowser read the recorded OOC conditioning aloud, noting the wording referenced an existing obligation on title.
Owner Paul Brannelly clarified that he did not see the restriction language in the COC document; Bowser responded that the restrictive language is standard and triggers on transfer. Chair John Sullivan noted the language had been improved and voted on by the commission about two years earlier and said any future work would require a new OOC.
A motion to approve the Certificate of Compliance, including the required deed language and four permanent conditions, passed by roll call vote 6-0.
