The Town of Walworth Planning Board on June 8 approved final subdivision of a 15.76‑acre parcel at 5335 Swadling Road into four lots, issuing a State Environmental Quality Review Act (SEQRA) negative declaration and granting a waiver from the town's depth‑to‑width ratio requirement.
Kevin Tung of Greene Land Surveying told the board the plan matches the version presented at the May meeting but required county approval. He said the proposal divides the property (Tax I.D. No. 61116-00947478) into four lots: New Lot 1 ±1.003 acres, New Lot 2 ±1.003 acres, New Lot 3 ±1.067 acres and New Lot 4 ±12.659 acres, with the southernmost lot containing an existing house and shed and another lot containing a barn.
The board opened a public hearing at 6:32 p.m.; no members of the public spoke. After closing public comment, Christopher Paap moved and Lou Villanova seconded a motion to approve the SEQRA negative declaration and the final subdivision resolution as presented. The board then recorded a roll‑call vote: Chairperson Landry — Aye; Christopher Paap — Aye; Lou Villanova — Aye; Kristen Rush — Aye. The motion carried unanimously.
The resolution documents the board’s findings on the Short Form EAF Part 2 (the board found all eleven Part 2 items to be "No, or Small Impact") and directs completion of Part 3 consistent with a negative declaration. It also finds that the proposed lots do not meet the town’s depth‑to‑width ratio (Section 180‑10[F](4)(a)) but that the deviation is minimal, will not adversely affect drainage, topography, vegetation or geological formations, and is consistent with the area’s residential character; the board therefore granted a waiver from the ratio requirement.
Approval was granted with conditions: outstanding comments from Town reviewers (including the Town Engineer and the Code Enforcement Officer) must be addressed to the satisfaction of the Planning Board chair before signatures are affixed to the subdivision plat; any required utility districting must be completed to the Town Board’s or its designee’s satisfaction; and the subdivision approval is subject to the time limits specified in the Town Code.
Chairperson Landry also noted during closing remarks that the board cannot move forward on a separate Double R Custom Homes application because of the 30‑day waiting period after the board was declared lead agency, and that there is no new information yet on the Windward matter; the board said it will notify the public when there is an update. The meeting adjourned at 6:33 p.m.
