Frederick County Zoning Board denies retaining-wall variance, approves garage and two chicken permits

The Frederick County Board of Zoning Appeals on May 28, 2026, denied a variance request to construct a retaining wall at 5613 Pine Bluff Court and approved three other land-use requests, the board’s minutes show.
The board, chaired by Dan Lawton, opened the meeting at 7:00 p.m. and first approved the April 23, 2026 minutes. The minutes record that Jack Felton moved to approve the April minutes, John Greenwell seconded, and the motion passed (recorded as 4-0-1).
In Case B-26-06, the applicant Reece sought a 19-foot variance from the 20-foot rear-yard setback and a 4-foot variance from two required 5-foot side-yard setbacks to allow construction of a retaining wall that would be up to 7 feet tall and set 1 foot from the property lines at 5613 Pine Bluff Court, Frederick. There were no public comments. After discussion, Jayna Shah moved to deny the variance; Jack Felton seconded. The motion to deny passed 5-0-0.
In Case B-26-07, applicant Pizzi requested a 40-foot variance from the required 50-foot front-yard setback in the Resource Conservation zoning district to build a detached accessory garage at 12016 Pleasant Walk Road, Myersville. There were no public comments. After discussion, Jack Felton moved to approve the front-yard variance; Jayna Shah seconded. The motion passed 5-0-0.
Case B-26-08 involved Carbonell’s request for a special exception to keep up to eight chickens (no roosters) on a 0.37-acre property at 4390 Amethyst Court, Middletown. No public comments were recorded. Jack Felton moved to approve the special exception; Jayna Shah seconded, and the motion passed 5-0-0.
Case B-26-09 concerned Thompson’s request for a special exception to keep up to 12 chickens (no roosters) on a 2.13-acre property at 2237 Regina Drive, Clarksburg. The minutes note one public comment in opposition. After discussion, Jayna Shah moved to approve the special exception; Shannon Bohrer seconded. The motion passed 5-0-0.
Chair Dan Lawton adjourned the meeting at 7:52 p.m. The minutes close with a standard note that all code references are to the Frederick County Code unless otherwise specified.
