Lago Vista Board removes rehearing items, tables officer election amid code-confusion debate

The Lago Vista Board of Adjustment used part of its Jan. 5, 2026 meeting to resolve several procedural items: it removed a rehearing of a previously denied height-exception application (23-2788-SP-E) from the agenda, moved another previously considered variance off the agenda, and tabled election of board officers until membership is settled.

Staff and council liaison remarks earlier in the meeting explained the city is in a transition of appointments: several current board members are being considered for planning-and-zoning roles and cannot serve on multiple boards, a change that has reduced the applicant pool and left some terms in flux. Several board members said it would therefore be inequitable to elect new officers before the board's final composition is known.

Board members also debated whether the reheard application could be considered given a 12-month cooling-off provision in the code. Staff described ambiguity in where the cooling-off language appears in the code and recommended that any motion include explicit language that the 12-month period apply unless material facts changed. Board members expressed concern that rehearing applications without substantial change would set an unacceptable precedent and that staff should be consistent in applying the code. A motion to remove the reheard item passed unanimously. A separate motion to remove the Belcher variance (an application for 3109 Parliament Cove) from the agenda also passed unanimously after members recounted prior votes and procedural confusion.

Separately, the board voted to table the election of chair and vice-chair, saying it will revisit officer elections once council appointments and board membership are confirmed. The board adjourned at 7:59 p.m.
