Patty White, who operates Whites Landing, told the board she learned during a routine inspection that her 2026 permit was listed as “under review” and that coalition staff had contacted the state to clarify whether her well should be regulated as a public water supply. "I was kind of surprised by it," White said, adding she has records showing the site’s tight tank and earlier permits and asked the board for clearer communication about the process.
Coalition representative Michelle and staff member Shelly explained they had sought technical guidance from state environmental/public-health officials because the application indicated a potential public-water-supply threshold and the records were unclear. Shelly said a revised as-built from an engineer showed the existing subsurface disposal system was over-designed and that the site had additional capacity; coalition staff nevertheless recommended a conservative path to protect the public.
After discussion, a board member moved to grant conditional approval for Whites Landing’s food permit contingent on a well water test and the state’s written determination of public-water-supply status. The board seconded the motion and took a voice vote to approve the contingency, allowing Whites Landing to operate while the Department completes its review.
The board asked White to provide the well test results and any documentation from the state showing whether the establishment meets the public-water-supply criteria; Michelle said the coalition would share contacts at the state and help expedite communications. The board also agreed to supply Patty a checklist of the specific tests the town will accept and to consider a short, formal condition in the permit that requires prompt submission of the requested documents.
Next steps: Whites Landing will obtain the recommended water tests and deliver results to the board; the coalition will share state contact information and the board will move to finalize the permit once the state’s determination is received.
