Acting Borough Attorney Kate Fina told the Borough of Caldwell Council on June 9 that the borough has received its fourth-round COAH certificate of compliance, which she said "protects the Borough against builders remedy lawsuits until 2035."
The certificate, Fina said during the public meeting at Saint Aloysius Church Gymnasium, requires a few reporting updates but does not require additional action by the council at this time. The announcement was made during the attorney's report near the close of the meeting.
The COAH certificate is an administrative compliance determination tied to affordable-housing obligations; Fina's statement framed it as a legal protection that reduces the borough's immediate exposure to developers pursuing so-called builders'-remedy litigation. The council did not take separate action on the certificate during the meeting.
The meeting record lists no further details on the reporting updates Fina referenced. The council adjourned the public meeting at 7:33 p.m.; the minutes were prepared by Municipal Clerk Brittany Heun.
