The Port Aransas Planning & Zoning Commission on June 29 voted to find Beachfront Dune Protection Permit Plan 26-20 consistent with the city's Coastal Management Plan for the property at 5601 State Highway 361, unit 111.
Planning staff reported a site visit and told the commission that there are no dunes or critical dune features at the construction site and recommended a consistency finding. "There are no dunes. There are no critical dunes there," a staff member said during the presentation. Staff recommended the applicant correct one exhibit reference that misstated a distance to vegetation; staff told the commission that the applicant would revise the exhibit to reference the property edge rather than the vegetation-line wording used in the application.
Commissioners asked clarifying questions about the proposed fence location and exhibit details; staff explained the fence alignment intentionally followed the back of the deck to avoid impacting dunes. Commissioner Felicia Foster moved to approve the no-dune permit consistency finding with changes to the vegetation line and exhibit details; Commissioner Bill Straber seconded. The commission recorded affirmative votes and the motion carried.
The approval does not authorize construction beyond what is permitted by other applicable permits; staff will require the applicant to submit corrected, higher-contrast exhibits and to include the requested permit numbers and clear lot descriptions in the final documents for the city record.
