Gaming Commission advances harness-racing rule updates, seeks emergency enactment for definitions

Associate General Counsel Melanie Fox presented three proposed amendments to chapter 205 CMR 3 covering harness-horse racing, saying the changes add precise definitions and correct citations that currently reference ARCI and USA rules without version clarity. Fox told commissioners the proposed amendment to 205 CMR 3.202 adds definitions that identify which versions of ARCI and USA rules apply; staff said an emergency enactment is needed so the new citations will be in place prior to the racing season start.

"The proposed amendment adds definitions for ARCI and USA that clearly identify which versions of the rules are being used," Fox said, adding that timing differences between ARCI and USA updates make emergency enactment necessary so standards are clear before April racing dates. Commissioners emphasized safety and consistency; Dr. Lightbound (director of racing and chief veterinarian) and the racing division were available for questions.

The commission voted to authorize emergency filing for 205 CMR 3.02 and to begin the promulgation process for 205 CMR 3.28 (prohibited practices) and 205 CMR 3.29 (medications and prohibited practices). Votes on the three actions were unanimous (5-0). Fox explained that removing an ARCI multiple-medication point system (section 2A) from 3.29 will not create an enforcement gap because judges already apply ARCI guidelines and established regulatory factors to determine penalties.

Why it matters: the amendments are technical but address safety, clarity and consistency for racing participants and animals ahead of the upcoming season. The emergency enactment for the definitions aims to avoid operator confusion caused by referencing unspecified rule versions.

Next steps: staff will file emergency and promulgation documents as authorized and continue coordination with the racing division and veterinarians.
