Houston council adopts ordinance banning marijuana sales within town limits

The Town of Houston council voted unanimously Feb. 27 to adopt a Codes Committee recommendation that prohibits the growing, manufacturing, testing and retail sale of marijuana anywhere inside the town's corporate limits.
The ordinance language the council approved states: "It shall be unlawful to grow marijuana, operate any marijuana cultivation facility, and marijuana product manufacturing facility, any marijuana testing facility, or any retail marijuana stores, or the selling of marijuana in any other business or facility within the corporate limits of the Town of Houston." The prohibition, as adopted, applies to all forms of marijuana and to all zoning districts listed by the town.
The vote followed a brief discussion in which Vice Mayor Tina King said she had asked Houston residents for their views and that "everyone she talked to was not in favor of anyone allowed to sell marijuana in Houston Town Limits." Councilman Gregory Gilmore moved to accept the Codes Committee recommendation; Councilman Dave Mutter seconded. The motion carried on a roll-call vote: Councilman Dave Mutter — Yes; Councilwoman Robin Adkins — Yes; Mayor Gregory Wingo — Yes; Vice Mayor Tina King — Yes; Councilman Gregory Gilmore — Yes.
During public comment, Bill Moore asked that meeting minutes be emailed to him, a request the council noted. The special meeting was called to order at 6:30 p.m. and adjourned at 6:53 p.m. on a motion by Councilman Mutter, seconded by Councilwoman Adkins.
The council's action implements the Codes Committee recommendation to opt the town out of state-authorized retail marijuana sales that are set to begin for Delaware residents on March 1, 2025, by making sale and related activities unlawful within the municipal corporate limits. The adopted language covers cultivation, product manufacturing, testing and retail sales across residential, commercial, industrial, agricultural and preservation zoning districts.
