Hinsdale zoning board grants special permit for 39 Eagle Road rebuild, caps size at 1,000 sq ft

The Hinsdale Zoning Board of Appeals voted 3-0 on April 28, 2026, to grant a special permit allowing applicant Jeffrey Lynch to remove the existing dwelling at 39 Eagle Road and rebuild on a different footprint, subject to conditions including a 1,000-square-foot size cap.

Chair Jeff Viner opened the hearing at 6:00 p.m. and read the attendance; Board members Bruce Alexander and Dan Thornton and Clerk Terry Douglas were present. Terry Douglas told the board she received one email requesting a copy of the application and plans and that public notice ran in the Berkshire Eagle on April 14 and April 21, 2026.

Lynch told the board he planned to demolish the current building because its "interior and exterior is in bad shape" and contractors told him to "knock it down and rebuild." He said the replacement would be "just one story," sited on a flatter portion of the lot farther from the property line, and would be about 25% larger than the existing structure. Lynch said he has consulted with the conservation committee and will meet with them again to determine well placement. When Chair Viner asked about tree removal, Lynch said he currently has no plans to remove trees.

After closing the evidentiary portion, Viner proposed—and Alexander seconded—restrictions that the new house not exceed 1,000 square feet and that construction adhere to the plans submitted with the application. The board voted, with Dan Thornton, Bruce Alexander and Jeff Viner voting yes, to grant the special permit under those conditions.
