The Village of North Fond du Lac Board of Trustees approved covenant terms for a proposed BE’s Refreshments building in the Northgate Business Park and subsequently voted to finalize a developer’s agreement after closed-session negotiations. During open session trustees asked that the building’s brick facade wrap around both sides to the first overhead doors and required staff approval of landscaping, lighting and stormwater plans as conditions of covenant approval.
President Michael Streetar moved to approve the covenants with the listed contingencies; Trustee Mike Will seconded and the motion passed 5-0. The board then met in closed session under Wis. Stat. §19.85 for deliberations and negotiations, including consideration of a developer’s agreement. After those closed-session discussions the board voted in open session to approve the developer’s agreement with BE’s Refreshments, LLC on a unanimous roll-call vote (Duffy, Hornung, Streetar, Schaub, Will).
The minutes record the approval and the contingencies but do not include the developer agreement’s financial terms, performance timelines, or any bonding/assurance provisions. The minutes also do not specify next steps for plan review or permits; those follow-up actions were left to staff review and approvals in the motion language.
