The Niskayuna Conservation Advisory Council voted unanimously July 1 to recommend that the Town Board issue a positive declaration requiring a full environmental impact statement for the proposed Niskayuna Harbor Planned Unit Development at 2757 Aqueduct Road.
The council recorded multiple concerns about the developer’s sketch plan, including extensive clearing and grading across a 41.6‑acre parcel that contains seven acres of federally‑jurisdictional wetlands and two acres of non‑jurisdictional wetlands, a shallow seasonal water table, stormwater detention basins located within or adjacent to wetlands, and residences sited close to the historic Erie Canal bank and the Mohawk‑Hudson bike/hike trail. The CAC’s recommendation follows its EAF Part Two review, in which members rated impacts to land, wetlands, groundwater and flooding as "moderate to large."
The CAC stressed hydrology and stormwater uncertainty. "We don't have the calculations of the storm order yet," a staff presenter said, noting the developer had not provided detailed flow or elevation data showing how detention basins would perform in a major storm. Council members cited a biologist's finding that the water table ranges roughly 6–18 inches below the surface and warned that lined basins could produce hydraulic mounding while unlined basins may simply fill and overflow into adjacent wetlands.
Members also focused on water quality and channel impacts. Council discussion flagged the risk that retention ponds could concentrate pollutants (pesticides, heavy metals, salts) and that concentrated outfall into the canal bed could increase erosion and degrade downstream wetland habitat. The site is bisected by an Erie Canal bed that the council identified as part of a nationally recognized historic corridor; councilors judged that high‑density buildings as close as 15 feet to the canal bank could have physical and visual impacts on that resource.
Traffic and circulation were additional concerns. Staff reported the developer’s trip generation estimate at about 81 PM‑peak trips, below New York State DOT’s 100‑trip threshold for a full traffic study but close enough that members recommended further analysis of visibility, left‑turn queuing, and potential effects on the nearby Rexford traffic circle. Councilors also noted multiple stub roads with limited turning areas for service and emergency vehicles; resolving turnarounds could require footprint changes that might affect buffers or wetland areas.
The council raised recreation and open‑space issues tied to density: the plan shows limited, narrow areas of usable green space between buildings and a proposed clubhouse/play area whose dimensions the council described as small for the projected population. Members asked the town and developer to ensure adequate on‑site recreation so residents do not overuse adjacent trails and wetlands.
After systematic EAF review of site‑specific questions (land disturbance, wetlands, groundwater, flooding, biological resources, visual/aesthetic impacts and historic resources), a council member moved to recommend that the Town Board issue a positive declaration; the motion passed unanimously with no nays or abstentions.
The CAC recommended the Town Board require a full EIS that examines detailed stormwater and groundwater modeling, alternatives that reduce near‑wetland building footprints (for example, taller buildings with smaller footprints), measures to protect the Erie Canal viewshed and the Mohawk‑Hudson bike/hike trail, and design standards for lighting and usable open space. The council said its vote does not prohibit a PUD on this site in principle but concluded that, as currently configured, the project raises multiple potentially significant adverse environmental impacts that require further study.
Next procedural step: the CAC will transmit its recommendation and the EAF findings to the Town Board for the board's seQR determination and any subsequent scoping of a required EIS.
