Durham planners approve private road maintenance agreement with conditions

The Durham Planning Board on July 1 approved a private road maintenance agreement for an extension of Claudia Road (Map 12, Lot 26B), voting to condition approval on the nine clarifications staff identified. The motion to approve carried after a presentation by staff and comments from the applicant’s representative.

Heather Roy, who said she was authorized to represent the buyers and sellers in the transaction, told the board she had not filled out some items the way the town expects but had since addressed “almost all of these conditions” and was prepared to provide the authorization letter and follow up materials the board requested. “I have since gone back and done some more work on this,” Roy said, offering to supply outstanding documents so town staff can verify the remaining items before the agreement is finalized.

Board members and staff explained the process: the board would approve the maintenance agreement subject to the nine items noted by the town’s reviewer (George). Staff and the road commissioner indicated they would check the outstanding items and sign off once the applicant had met the conditions. The record shows the board moved, seconded and approved the conditional motion; public comment was not taken on the item.

The approval does not change the rights of any landowner who formally declined to join the maintenance agreement; one parcel owner told the board he had opted out and would not share road maintenance costs. Town staff said the agreement’s final form would reflect those exhibit changes so tax and maintenance obligations are clear.

The board moved immediately to the next agenda item after the vote.
