Planning Commission OKs Hibiscus remodel, approves coastal and nonconforming permits

The Carlsbad Planning Commission on July 1 approved a coastal development permit and a nonconforming construction permit for a large addition to the single‑family home at 3995 Hibiscus Circle.
Senior planner Kyle Van Lewin presented staff’s recommendation, saying the project — which would expand the existing about 1,141‑square‑foot house by roughly 2,790 square feet and result in four bedrooms, an office, covered patios and a separate accessory‑dwelling unit processed under a separate permit — is consistent with the general plan, zoning and the local coastal program and is exempt from CEQA. "Staff's recommendation is to adopt a resolution approving the CEQA exemption and the coastal development permit and nonconforming construction permit," Van Lewin said.
The applicant briefly addressed the commission and said the ADU would house a multigenerational family. Commissioners asked clarifying questions about parking for the ADU and the legal status of existing nonconforming elements. Commissioner Fitzgerald asked whether the ADU parking was expected to rely on on‑street space because no additional garage space was proposed; Van Lewin noted state ADU law limits how much parking local jurisdictions may require and that the driveway depth can satisfy parking where applicable.
Commissioners also discussed a condition requiring the property owner to demonstrate the existing structure was lawfully established or to cure nonconforming elements. Van Lewin outlined options for the owner to either document prior permitting or to relocate or modify nonconforming features during later permitting steps.
Commissioner Burrows moved to approve the staff recommendation; the motion was seconded and passed. The commission recorded the vote as five in favor with two commissioners not present (recorded as abstaining/not present).
The decision is final for the Planning Commission but may be appealed to City Council within 10 calendar days, staff reminded commissioners. The commission closed the public hearing on the item and moved to the next agenda item.
