Council approves Verizon water-tower easement language after LMC legal review
Summary

At the March 16 meeting the Mahnomen City Council approved execution of an amended Verizon lease and easement agreement and passed a resolution acknowledging the municipality’s tax-exempt status. City staff reported that the League of Minnesota Cities (LMC) provided recommended contract language that Verizon accepted and the city incorporated into the agreement.
The incorporated LMC recommendations described in the packet include: a requirement that Verizon conduct, at Verizon’s expense, an engineering study and obtain prior city approval if additional equipment would affect the water tower’s structural integrity; provisions outlining coordination when the city needs to repaint or perform maintenance or repairs; and decommissioning language requiring Verizon to remove equipment following an up-to-180-day notice from the city to allow Verizon to make arrangements.
City Administrator Taylor Guenther reviewed the LMC legal review and told the council the added language strengthens the city’s protections. The council approved Resolution 3-16-2026-1 by unanimous vote; no financial terms of the lease were included in the minutes excerpted in the packet.
