Conservation commission rescinds enforcement order, issues Order of Conditions for 88 Camp Street riverfront work

The Milford Conservation Commission on April 23 rescinded an Enforcement Order and issued an Order of Conditions for riverfront work at 88 Camp Street (DEP 223-1261) after reviewing revised site plans, a supplemental Notice of Intent, a Riverfront Analysis and a Riverfront Area Mitigation Plan submitted in mid-April.
Town Engineer and applicant representatives from Goddard Consulting told the commission that the restoration plan required by MassDEP was submitted by the April 15 deadline and that the project design had been revised to meet riverfront permitting standards. The Town Engineer said the Order of Conditions will incorporate the Riverfront Area Mitigation Plan dated April 14 and will include a monitoring condition.
The Town Engineer also summarized permitting context: the lot remains “not a separate building lot” under local building code considerations and improvements to Camp Street will be presented to the Milford Planning Board under MGL Chapter 41 provisions; the commission noted that 310 CMR 10.05(4)(e) excludes approvals required by Subdivision Control Law or building-code permits from the commission’s jurisdiction.
Public comments were received from nearby residents (Rebecca and Joe DeMarco of 7 Leah Lane and Al and Sharon Correia of 3 Leah Lane). Following discussion, the commission voted twice: first to rescind the Enforcement Order (motion by John Erickson, second by Jeff Frederick), then to close the public hearing and issue the Order of Conditions with the special conditions drafted by the agent (motion by Jeff Frederick, second by John Erickson). Both motions carried 6–0.
The Order of Conditions will include deadlines and monitoring requirements for the riverfront restoration; the Conservation Agent confirmed in the record that this approach was acceptable to MassDEP.
