Town of Union approves agreements and waives new application fees for Kot Road solar development

The board approved Stormwater Control Facility Maintenance Agreements, Decommissioning Agreements, Host Community Benefit Agreements and a Payment In Lieu Of Taxes (PILOT) alternative agreement and authorized Supervisor Robert Mack to execute the documents upon approval by the Town Attorney and upon full execution by the developers. The resolutions were adopted unanimously.
Separately, the board voted to waive the newly enacted application fees for solar developers for this project on the grounds that the Kot Road/LSE Titan application was filed before the new fee schedule and that the project was already advanced in the approval process. That waiver was also adopted unanimously.
The minutes specify the approvals are conditioned on final execution by the developer entities and review by Town Attorney Alan J. Pope. The clerk's record does not list any substantive dissent or amendments during the vote.
