City Attorney presents charter amendment to clarify quorum and voting rules

City Attorney Thomas Mitchell presented a draft home-rule ordinance at the March 3 work session that would amend Section 2.21 of the City of Demorest Charter to clarify quorum and voting procedures.
Under the draft, a quorum would be met either by three seated councilmembers or by two councilmembers together with the mayor; the same grouping would be authorized to conduct city business. Ordinances would default to adoption by voice vote unless a roll-call vote is requested; the ordinance would require three affirmative votes to approve most actions or, alternatively, authorization by the mayor together with two councilmembers. The mayor would vote only to break a tie or when vacancies reduce the number of seated councilmembers below a quorum. The draft also addresses how vacancies and tie votes are handled so that remaining members, including the mayor, may act until vacancies are filled.
Mitchell framed the amendment as clarifying existing practice and reducing uncertainty about when the mayor may vote and how many affirmative votes are needed. The council discussed the mechanics of voting thresholds and did not adopt the ordinance during the work session; further consideration and formal action would occur at a subsequent meeting if the council elects to advance the draft ordinance.
