Chair Celeste Donovan opened the hearing and a representative from R. Levesque Associates presented a counter estimate for restoration seed costs, saying the City Engineer’s earlier figure was too high. The commission agreed with the R. Levesque estimate and set the fine at $10,298.
Commissioners voted 5-0 to table approval of the Certificate of Compliance for File NOI 19-007 until April 15, 2026. The motion to table was made by Commissioner Charles Payne and seconded by Commissioner Richard Valcourt. Staff told the commission that if the fine is paid before April 15 and the commission approves the Certificate of Compliance, a new Notice of Intent for the property could be heard on May 6, 2026.
The action keeps the enforcement matter open: the fine must be paid prior to the April 15 meeting for the commission to sign the Certificate of Compliance and for the applicant to proceed with a new filing. No work to implement the original restoration plan has occurred on the property to date.
