A representative from R. Levesque Associates disputed the City Engineer’s earlier seed‑cost estimate for the restoration plan associated with NOI 19‑007, arguing the City’s figure was too high. The commission accepted R. Levesque’s lower estimate and established a fine of $10,298 to be paid before April 15, 2026 as a condition for approving and signing the Certificate of Compliance. Charles Payne moved to table the request to April 15; Richard Valcourt seconded and the motion passed 5‑0.
Staff told the commission that no remedial work had been performed on the property since the Enforcement Order issued in April 2019 and that the original Order of Conditions and Restoration Plan dated January 22, 2020 remained open. Commissioners and the R. Levesque representative agreed the negotiated fine amount was fair; both parties indicated the fine must be settled for the commission to consider closing the file.
If the fine is paid and the Certificate of Compliance is approved at the April 15 meeting, staff said the new Notice of Intent for the proposed project on the property could be scheduled for a May 6, 2026 hearing. The commission’s action was procedural — tabling the request pending payment and documentation — rather than an approval of the Certificate of Compliance.
