Council withholds local recommendation on Dugout Bar liquor license; authorizes mayor to sign ownership form

City clerk Michael Chhaterson presented a public hearing on a Class C liquor license application for the Dugout Bar (239 E. 6th) under new owner Debbie Forner and explained the public hearing was on the 46th day relative to the 45‑day review window. Chhaterson said the state liquor control commission advised the city could make no recommendation but noted the state commission has final approval and that the city would typically recommend only when there are protest issues.
After brief council discussion about legal exposure and timing, Councilman her moved "to withhold our recommendation due to the fact that it is one day outside of the window," and Councilman Marsh seconded. The motion carried six yays and one nay. The city's position will be no recommendation to the Nebraska Liquor Control Commission unless protests arise.
On a related administrative matter, council later authorized the mayor to sign Form 50G to record the change of ownership for the Dugout Bar's satellite keno operations. Councilman Jensen moved to authorize the mayor to sign the form; the motion was seconded and carried 7–0.
The state liquor control commission retains final authority over the Class C license and will act on the application following its review procedures.
