City staff described an immediate need to address public-health and property risks from persistent debris and said the contract will be procured as a small public-works project without formal advertising under the bid-threshold exception. The estimated contract total was described as not to exceed $30,000.
During council questions, members asked how the city would manage overlap with its existing contract with Waste Connections. Administration representatives said the city could short-pay Waste Connections for failures to meet a ‘‘three-day’’ performance obligation in the existing contract and that legal exposure is possible; the city attorney and staff said they would evaluate any litigation risk.
Staff said the awarded contractor planned to begin work the next day with one truck and would provide receipts; the council adopted the emergency ordinance by roll call after a short public-hearing period with no public speakers.
The ordinance record instructs staff to provide receipts and documentation; the council asked staff to monitor progress and report back.
