Buford commission approves rezoning and variances for three Thunder Road parcels for Tipton Builders

Chairman Phillip Beard and the Buford City Commission unanimously approved rezoning requests for three adjacent Thunder Road properties to allow single-family residential development.
The commission voted 3-0 on March 3 to rezone 448, 450 and 456 Thunder Road from M-1 to R-100 at the request of Tipton Builders Group. Matt Cape spoke for the applicant; no members of the public spoke in opposition during the hearing.
The approvals include the same ten development conditions for each property. Key conditions require the applicant to submit a minor plat meeting City of Buford Development Regulations Code Section 3.4.3(a-e) before building permits are issued; grant lot variances that reduce lot sizes (examples include reductions from 20,000 sq. ft. to as small as 8,927 sq. ft. on certain lots) and lot widths; reduce side setbacks from 10 feet to 5 feet; and provide a house location plan approved by the Planning Director.
Homes on the parcels must be constructed with four-sided brick or stone and may use accent materials (brick, stucco, rock, shakes, hardiplank, concrete siding) on no more than 20% of each elevation, and must have a minimum gross heated floor area of 3,400 square feet (exclusive of garages and basements) and a minimum two-car garage. Driveways must be at least 18 feet wide. Front, side and rear yards must be sodded and include two 3-inch ornamental trees in front yards. Road improvements — including curb and gutter and 5-foot sidewalks — are required along Thunder Road, and right-of-way dedication must include existing and proposed improvements. Rentals will be limited to one home per development, and protective covenants and restrictions must be recorded on deeds and approved by the Planning Director.
The rezoning motions were made by Vice-Chairman Chris Burge and seconded by Commissioner D Bradley W. Weeks; each motion carried 3-0. The conditions reference the City of Buford Development Regulations Code Section 3.4.3(a-e) as the governing plat standard.
The commission did not record any public opposition during the hearings, and staff did not identify outstanding legal or procedural objections at the meeting. The next procedural step is permit review and submission of the minor plats described in the approvals.
