Weld County accepts $5.43 million decommissioning bond for Weld Energy Center special review permit

Angela Snyder, Planning Services project lead, asked the board to accept a decommissioning plan and associated project collateral for special review permit USR25-000018, filed by the Colorado State Land Board care of Weld Energy Center LLC. Snyder said the plan complies with code and that the applicant submitted an irrevocable standby letter of credit bond in the amount of $5,431,300 to cover estimated decommissioning and reclamation costs.
"The decommissioning bond in the amount of $5,431,300 has been submitted by the applicant to address the decommissioning and reclamation of the facility," Snyder said, adding staff recommends acceptance. Snyder also noted USR25-000018 was conditionally approved by the board on Dec. 17, 2025 and that the bond satisfies condition 5A of that approval. The applicant was present for the hearing and did not add remarks.
Why it matters: Planning staff said acceptance of the bond fulfills a condition of approval and ensures funding is available for reclamation after project closure. The presentation linked the security to code requirements intended to protect county resources and land reclamation obligations.
Board action: Commissioner Buck moved and Commissioner Ross seconded acceptance of the decommissioning plan and project collateral; the motion carried on voice vote.
Next steps: With the board’s acceptance, Planning Services will record the collateral and proceed with associated permit administration.
