The Avon Zoning Board of Appeals on June 19 unanimously approved a 5‑foot variance from the town’s 20‑foot side‑yard setback to permit a backup generator at 34 Richard Street.
Andrew Morse, a principal with AMCO Development LLC, told the board the south side of the property is the best location because it is the furthest point from neighboring residences; he said the abutting property to the south is Beth‑El Cemetery and that a perimeter fence prevents visibility from nearby homes. Morse added the proposed generator location is outside the Town’s regulated wetland upland review area, avoiding the need for a trench or disturbance within that zone.
Kyle noted the property is bisected by a regulated upland review area tied to an adjacent wetlands feature and described that constraint as part of the hardship supporting the variance request. Vice Chair Jaime Polhamus said the proposed siting made sense given the information presented, and the board closed the public hearing and voted to approve the 5‑foot setback variance unanimously.
The ZBA record indicates the board relied on the site’s screening, distance from residences and avoidance of regulated areas in finding the variance would not injure the neighborhood. Town staff explained next procedural steps to the applicant after the vote.
